How is child support determined?

Oklahoma’s laws regarding child support were changed as of July 1, 2009. Today, child support in Oklahoma is based on calculations that take the following into consideration:

Each parties’ gross monthly income;
Are there any statutory adjustments applicable to either parties’ income;
Health insurance expenses
Are there any continuing monthly health care costs outside of the monthly premium;
Monthly child care expenses;
Number of nights the children stay with each parent per year

However, this impersonal system does not take into account factors such as:

increases or decreases in salary
relocation for a new job or other reason
layoffs or sudden job loss
changes in child support or visitation agreements
prolonged illness or accidents resulting in personal injury
either spouse remarrying

What is Considered Gross Monthly Income in Child Support?

Gross monthly income includes earned and passive income from any source, except as excluded by statute. Gross monthly income will include, but is not limited to:

Salaries
Wages
Tips

Bonuses
Commissions
Interest income

Pensions
Rent
Trust income

Gifts
Royalties
Fringe benefits

Often individuals will want to make a case that bonuses are not guaranteed or can change therefore they do not want to include them. However, in accordance with the law, they will be included as income.

Failure to pay child support or comply with the court ordered child support stipulations may impact your credit history, result in garnishment of wages, and possibly even jail time. In some extreme cases, the state of Oklahoma may seize certain assets or property.
